Letters and Papers Foreign and Domestic Henry VIII 1513. 12 Jan 1513. Spinelly (age 41) to Henry VIII. Wrote last on the 9th. A messenger has since come from the Emperor, and brought the conclusions of the negotiations made in Germany, of which he sends a Latin translation [See 08 Oct 1512]. My Lady has told him of the honorable treaty which the Emperor has made with the Swiss, of which he sends a copy. Madame is advertised from Savoy that the Swiss are not well disposed to the French, and only negotiate with them to obtain money from them and the castles of Lucam and Luca[rno]. Sir Tho. Boleyn (age 36) tells him the better part of the town of Serizee are French. The two brothers (freres) whom Spinelly sent to England were among the best of them. Leaves the truth of his words to time. When the Controller of the Household comes, he will know it from the information of Madame and De Berghes. Serizee, in the late rebellions, took part with De Ravestain. Boleyn is dissatisfied, because he was not informed of the resolution taken with the said two brothers. Was at Antwerp at the time. The treasurer general of the Prince of Castile has been at Cologne, waiting for an envoy from Gueldres to arrange for a truce between the two. Gueldres has now notified that he can find no personage to send. A messenger has been taken, sent by the Bastard of Gueldres into France to state that if he was assisted he would pillage all the flat country of Brabant. The Hollanders have agreed to raise 1,200 foot for the Duke of Brunswick, and will have nothing to do with Diselstain. The said Duke has now 3,000 foot and 1,000 horse, and continually harasses the enemy. Heda, maître d'hotel of the Duke of Gueldres, has left the Court of France, bringing money and aid to his master. Watch is laid for him. Philip Galteroty is now at Malines. He has great friendship in Scotland, on account of his managing the ecclesiastical matters at Rome. He tells Spinelly that some Scotchmen from the Court of France informed him that Jaques Hogby, the resident there, had powers a month past, and made a new treaty between their master and France, binding their master to make war on England, and the King of France to send to Scotland 200,000 crowns of gold, and a certain quantity of arms and gunpowder, and 20 pieces of artillery. Philip says that four vessels of war have gone thither already with arms, &c., but the money does not go till March. Many of the Scotch are dissatisfied with England, and say they have been plundered, and will have revenge. The Secretary of Scotland has lost his cause at Rome, in the matter of the commandry of St. John's in Scotland, through the influence of the Card. of York, at which he is very angry. The Bishop of Murray and the Secretary are omnipotent with the King of Scotland. The King of France has promised the former a Bishopric. Will send to-morrow to De Berghes to learn Scotch news from his son-in-law of Canferre, where the Scotch lodge. On his asking Madame if he should send the maître d'hotel of the Prince of Chimay to Blois, as he did last year, she replied that she expected satisfactory news from the Emperor in six days, and the Governor of Bressa would be sent in quest of the maitre d'hotel in her name, to make inquiries by means of D'Albret. Gave the Governor 100 fl. for the said maitre d'hotel. Wants money. Upon the King's letters, Madame has given a passport to Richard Fermer, to export, duty free, 36,000 rasieres of wheat or flour. The Parliament was unexpectedly prorogued to 2d of April to the discontent and surprise of many members who, being exceedingly averse to the settling of anything, proceeding with animosities, multiplying exceptions against those whom they pronounced obnoxious, and producing as universal a discontent against King William (age 39) and themselves, as there was before against King James (age 56). The new King resolved on an expedition into Ireland in person. About 150 of the members who were of the more royal party, meeting at a feast at the Apollo Tavern [Map] near St. Dunstan's [Map], sent some of their company to the King, to assure him of their service; he returned his thanks, advising them to repair to their several counties and preserve the peace during his absence, and assuring them that he would be steady to his resolution of defending the Laws and Religion established. The great Lord suspected to have counselled this prorogation, universally denied it. However, it was believed the chief adviser was the Marquis of Carmarthen (age 57), who now seemed to be most in favour.

John Ashton Edmund Elliot Richard Graham 1691. On Fryday, the 2d day of this Sessions, my Lord Preston (age 41), John Ashton and Edmund Elliot, were all Arrained for High Treason, my Lord Preston was Tryed on Saturday by the name of Sir Richard Graham, Mr. Ashton on Monday. The Indictments against them consisted of Two Parts, the First of which set forth, That they had a Treasonable Design carrying on to Depose the King and Queen, and to Subvert and Alter the Government of the Kingdom of England, and to raise War and Rebellion in the same; which said Traiterous and Wicked Designs and Purposes to bring to pass, they did, on the 29th of December last, Meet and Conspire together, with several other Traitors not yet discovered, and did Compose several Treasonable Letters, Notes and Memorandums in writing, which set forth the most effectual way and means how they might Dethrone and Depose our Most Gracious Sovereign Lord and Lady the King (age 40) and Queen (age 28), and further describing therein how the Affairs of this Kingdom stood, and of what Strength and Force our Shipping was; as also the Fortifications of several Sea-Port-Towns within this Kingdom. The Second Part was their adhering to the Kings's Enemies: And to that end, that they might Acquaint Lewis the French King of the same, they did hire a Boat and Embarque themselves in order to Transport themselves and Pacquet of Treasonable Letters into France, agreeing to pay for their said Passages the Sum of One hundred Pound; and, in order to their Treasonable Voyage, they had made their Passage as far as below Gravesend [Map], but were then Taken by Captain Billop, who Cruised abroad to search for them.

After this the Evidence for the King being called, gave an Account particularly from Step to Step, how cunningly and subtilly they managed this horrid Conspiracy, by hiring the Smack called the Thomas and Elizabeth, to convey them secretly into France; in order to which they took Water in a Skuller at Surrey-Stairs, and went on Board the aforesaid Vessel, which lay in the River of Thames over against the Tower [Map]: From thence they set Sail down the River, till coming within the View of the George Frigate, lying in Long-reach, they desired the Master of the Smack to hide them under the Quarter-Hatches; which was done, they having some Fear of being discovered: There they remained till past that Danger, and then came up; but when they were within Sight of Gravesend [Map] they hid again, and a little below it Captain Billop came aboard them, under Pretence of Pressing the Masters two Men, who were assistants to him; but indeed his Design and real Intention was to find out those Traytors, which, upon Search, he found lying along under the Hatches; and after their being haled up he search'd them, and found a Pacquet of Treasonable Papers in Mr. Ashton's Bosom: which he with the Prisoners carried before my Lord Nottingham; who examined the Papers, and after being examined by the Cabinet Council they were committed to the Tower. The Evidence was very full and plain against them both, much to the same effect and purport: The Letters being also Read against them in Court, were adjudged to be of no less Import than High-Treason. Upon the whole they had nothing material to offer in their Defence; so after a very long hearing, they were both found Guilty of High Treason. Edmond Elliot was ordered to remain till further order.

Greville Memoirs. 12 Jan 1831. Passed two days at Panshanger [Map], but my room was so cold that I could not sit in it to write. Nobody there but F. Lamb (age 48) and J. Russell. Lady Cowper (age 43) told me what had passed relative to the negotiation with Melbourne last year, and which the Duke or his friends denied. The person who was employed (and whom she did not name) told F. Lamb that the Duke would take in Melbourne and two others (I am not sure it was not three), but not Huskisson. He said that it would be fairer at once to say that those terms would not be accepted, and to save him therefore from offering them, that Melbourne would not be satisfied with any Government which did not include Huskisson and Lord Grey, and that upon this answer the matter dropped. I don't think the Duke can be blamed for answering to anybody who chose to ask him any questions on the subject that he had made no offer; it was the truth, though not the whole truth, and a Minister must have some shelter against impertinent questioners, or he would be at their mercy. An Envoy (age 20) is come here from the Poles¹¹, who brought a letter from Prince Czartoryski to Lord Grey, who has not seen him, and whose arrival has naturally given umbrage to the Lievens.

Note 11. This Envoy was Count Alexander Walewski, a natural son of the Emperor Napoleon, who afterwards played a considerable part in the affairs of France and of Europe, especially under the Second Empire. During his residence in London in 1831 he married Lady Caroline Montagu (age 22), a daughter of the Earl of Sandwich, but she did not live long. I remember calling upon him in St. James's Place, and seeing cards of invitation for Lady Grey's assemblies stuck in his glass. The fact is he was wonderfully handsome and agreeable, and soon became popular in London society.

On 12 Jan 1921 Gervase Elwes (age 54) was killed in a railway accident at the Back Bay Railway Station. Elwes and his wife (age 52) had alighted on the platform when the singer attempted to return to the conductor an overcoat that had fallen off the train. He leaned over too far and was hit by the train, falling between the moving carriages and the platform. He died of his injuries a few hours later.
